Swyp Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Swyp ("the App"), you agree to be bound by these Terms of Use ("Terms"). This agreement is solely between you and Mukesh Khatri ("Developer"), not with Apple Inc. If you do not agree to these Terms, do not use the App.

You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

2. License Grant

Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by Apple's App Store Terms of Service and Usage Rules.

This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

3. Description of Service

Swyp is a photo library management application that helps you organize and clean your iOS photo library by:

• Detecting duplicate and similar photos
• Identifying blurry or low-quality images
• Finding screenshots and downloaded content
• Locating large video files
• Detecting memes and internet-sourced images
• Browsing and cleaning your library by month
• Surfacing memories from this date in past years (On This Day)
• Sending optional cleanup reminders via local notifications

The App provides an interactive interface for you to review and delete unwanted photos from your device.

4. Photo Deletion — Recently Deleted Album

Photos deleted through Swyp are moved to your device's "Recently Deleted" album using standard iOS deletion methods.

YOU ACKNOWLEDGE AND AGREE THAT:

• Deleted photos are moved to the "Recently Deleted" album where they remain for 30 days
• Photos can be recovered from "Recently Deleted" within 30 days through the iOS Photos app
• After 30 days, photos are permanently deleted by iOS automatically
• You can manually empty "Recently Deleted" at any time through the iOS Photos app
• You are solely responsible for reviewing each photo before confirming deletion
• The App provides review screens before deletion, and it is your responsibility to use them carefully
• The App does not control the "Recently Deleted" album — this is managed by iOS

5. No Liability for Deleted Photos

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER IS NOT RESPONSIBLE OR LIABLE FOR:

• Any photos, videos, or media files deleted through the App
• Loss of memories, sentimental value, or emotional distress from deleted content
• Accidentally deleted photos due to user error or misuse
• Data loss of any kind resulting from use of the App
• Photos incorrectly categorized as duplicates, blurry, or screenshots
• Any consequences arising from the deletion of photos

YOU USE THIS APP ENTIRELY AT YOUR OWN RISK AND ACCEPT FULL RESPONSIBILITY FOR ALL DELETIONS.

6. User Responsibilities

You agree to:

• Carefully review all photos marked for deletion before confirming
• Maintain your own backups of important photos (via iCloud, computer, or other backup methods)
• Use the App's review and undo features before finalizing deletions
• Accept full responsibility for all deletion decisions
• Not hold the Developer liable for any deleted content
• Comply with all applicable third-party terms of service when using the App

7. Privacy and Data Processing

• All photo analysis and processing occurs locally on your device
• No photos or photo data are uploaded to external servers
• The App requires photo library permissions to function
• The App does not collect, store, or share your photos

Analytics: The App collects anonymous usage events (e.g. scan started, photos deleted, paywall viewed) and sends them to PostHog, a third-party analytics service. These events include aggregate counts such as photo counts and storage sizes, but never the actual contents of your photos. This data is used solely to improve the App. PostHog's privacy policy is available at posthog.com/privacy.

Notifications: If you grant notification permission, the App may send local reminders to clean your photo library. No notification data is transmitted to external servers.

8. Subscription and Payment Terms

• The App offers a free tier covering your first 5,000 photos
• Unlimited scanning is available via a Pro subscription (monthly or yearly)
• All purchases are processed through Apple's App Store and charged to your Apple ID account
• Your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel your subscription at any time in your App Store account settings (Settings > Apple ID > Subscriptions)
• Cancellation takes effect at the end of the current billing period — you retain access until then
• Refunds are subject to Apple's refund policy

9. Accuracy of Detection

The App uses algorithms to detect duplicates, blurry photos, and other categories. However:

• Detection is not 100% accurate
• Some photos may be incorrectly categorized
• Visual similarity detection uses a threshold and may produce false positives
• You must verify each photo before deletion
• We make no guarantees about detection accuracy

10. Maintenance and Support

The Developer is solely responsible for providing maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility.

12. Limitation of Liability

IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of data, photos, or content
• Loss of profits or revenue
• Emotional distress or sentimental loss
• Any damages exceeding the amount paid for the App (if any)

This limitation applies even if we have been advised of the possibility of such damages. The Developer, not Apple, is responsible for addressing any claims relating to the App or your use of the App.

13. Indemnification

You agree to indemnify and hold harmless the Developer from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Deletion of your photos
• Violation of these Terms
• Violation of any rights of third parties

14. Intellectual Property

In the event of any third-party claim that the App or your possession and use of the App infringes a third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

15. Legal Compliance

By using the App, you represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
• You are not listed on any U.S. Government list of prohibited or restricted parties

16. Apple as Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer is located, without regard to conflict of law principles.
